B’nai Brith Canada urges appeal to Supreme Court of Canada in Oberlander matter
TORONTO, November 18, 2009 – B’nai Brith Canada has stated that the latest decision released by the Federal Court of Appeal on the Nazi-era case of Helmut Oberlander serves only to further the shameful record of inaction that mars Canadian justice in this area. The Court, in a 2-1 decision, has ordered the Federal Cabinet to revisit its decision to strip Oberlander of his citizenship for lying his way into this country. Earlier decisions clearly found that he was a member of the notorious and deadly killing squad known as Einsatzgruppe. B’nai Brith Canada will urge the Government of Canada to apply for leave to appeal this ruling to the Supreme Court of Canada.
“This judgment shows that Canada remains a haven for persons against whom there are serious reasons for concluding that they are complicit in war crimes; an appeal is essential to attempt to salvage the integrity of the system,” said David Matas, Senior Legal Counsel of B’nai Brith Canada.
“B'nai Brith is litigating in the Nazi-era cases of Katriuk and Odynsky. At issue is whether, in such revocation cases, the Federal Cabinet can even consider issues other than lying on entry. These cases are pending in the Federal Court of Appeal, having been rejected by the Federal Court.”
